The U.S. Department of Education has released final regulations under the No Child Left Behind Act (NCLB) and the
Individuals with Disabilities Education Act (IDEA) providing additional flexibility to states to more appropriately measure the achievement of certain students with disabilities. These regulations allow states to develop modified academic achievement standards that are challenging for eligible students and measure a student's mastery of grade-level content, but are less difficult than grade-level achievement standards. The new regulations are part of an ongoing effort to ensure that all students, including those with disabilities, fully participate in a state's accountability system and are assessed in an appropriate and accurate manner.

This site was created to provide a "one-stop shop" for resources related to IDEA and its implementing regulations, released on August 3, 2006. It is a "living" website and will change and grow as resources and information become available. When fully implemented, the site will provide searchable versions of IDEA and the regulations, access to cross-referenced content from other laws (e.g., the No Child Left Behind Act (NCLB), the Family Education Rights and Privacy Act (FERPA), etc.), video clips on selected topics, topic briefs on selected regulations, links to OSEP's Technical Assistance and Dissemination (TA&D) Network and a Q&A Corner where you can submit questions, and a variety of other information sources. Building the Legacy Training Curriculum on IDEA 2004
The National Dissemination Center for Children with Disabilities (NICHCY) has produced training modules as part of the Building the Legacy Training Curriculum on IDEA 2004.  In all, 19 modules on critical IDEA topics will be available by summer 2007. With this newest posting, 7 are already available.

IDEA 2004 Regulations

      

IDEA 2004--Part B Final Regulations
The U.S. Department of Education has announced the final Part B regulations to implement the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). The regulations and other IDEA 2004 resources are available on the US Department of Education Office of Special Education Programs (OSEP) website.  Please note that these regulations take effect on October 13, 2006.  See below for a link to the IDEA’97 regulations.

Model Forms
As part of the 2004 reauthorization of the IDEA, Congress included a requirement that:
"Not later than the date that the Secretary publishes final regulations under this title, to implement amendments made by the Individuals with Disabilities Education Improvement Act of 2004, the Secretary shall publish and disseminate widely to states, local educational agencies, and parent and community training and information centers."
